DEED OF TERMINATION OF TENANCY - FORMAT

This deed of termination of tenancy is made on this _____ day of ____ 2013 between Mr._____ son of ____ resident of _____, Lahore (hereinafter referred to as the tenant) of the one part and Mr.____ son of ____ resident of _____, Lahore, (hereinafter referred to as the owner) of the other part.

And whereas on ____ an agreement was entered into by and between the tenant and the owner whereby and whereunder the owner let out to the tenant ____ storeyed building along with the basement measuring ___ Marlas situated at _____, Lahore at a monthly rental of Rs. ___/- till ___ (hereinafter referred to as the “Rent Agreement”). The rent agreement may be considered as part of this deed. 
And whereas under the rent agreement and pursuance thereof, the said owner gave occupation of the said building to the tenant and the Tenant had been in occupation thereof since then.
And whereas both the parties mutually decided to terminate the rent agreement/tenancy and in furtherance thereof the tenancy was terminated and vacant possession of the property was delivered to the owner on ____ by the tanant. With a view to avoid any possible litigation and expenses both the parties, hereby, are executing a deed of termination of tenancy.
Now therefore this deed witnesseth and the parties agree as follows:
1. The said owner hereby admits confirms and acknowledges that on ___ day he had received peaceful vacant possession of the said building comprising of (details of property).
2. The owner has received the vacant possession of the building with all fittings and furniture, water, drainage, sanitary fittings and electrical installations in the same good order and conditions as they were when the said building was let out to the tenant and the owner has no claim whatsoever against the tenant in relation to the said building.
3. The tenant declares that it has not created any encumbrance over the said flat and the same is free from all encumbrances.
4. The owner agrees and declares that the tenant has paid all dues, including rent and electricity bills in respect of the said building up to the day of termination of tenancy i.e. ____ and nothing is due or payable by the tenant to the owner in respect of the said building.
5. It is recorded that the Security Deposit of Rs. ____/- has already been refunded to the tenant in cash on receiving peaceful vacant possession of the said building and the receipt thereof the tenant hereby admits.
6. The tenant had installed an electricity transformer on the said building and spent Rs.____/- thereupon. The owner has already paid Rs.___/- to the tenant on receiving peaceful vacant possession and the receipt thereof the tenant hereby admits.
7. It is recorded that neither party has any claim against the other in relation to the said building.
